A new type of services provided by Mogilev Branch of the Chamber of Commerce and Industry.
Mediation - it is the agency, help provided to a third party in the peaceful resolution of disputes.
Why is a mediator important?
A mediator shall prepare, arrange and conduct negotiations, which are aimed at development of mutually acceptable solution for both parties. He will draw up a mediation agreement complying with the legislation of the Republic of Belarus. The mediation is a paid work. The amount of remuneration and payment is established by agreement between the parties of the dispute.
How is a mediation agreement fulfilled?
In case a mediation agreement is entered into by the parties to a dispute, it is subject to execution on the basis on the voluntariness and good faith of the parties. It is also possible to enforce a mediation agreement on the basis of current legislation.
What is the negotiation process?
1. Each party to a dispute shall describe its vision of the situation and issues to discuss;
2. There should be formed a range of issues that the parties want to discuss;
3. During the discussion of issues everyone can express their opinion, propose solutions, assess their feasibility.
4. It is possible to conduct individual conversations with the mediator at his initiative or at the request of any of the parties;
5. As soon as mutually acceptable solutions to the dispute are found, there text of an agreement should be prepared;
