Important: the report provided based on the results of the service is not an official conclusion, interpretation, explanation of the application of regulatory legal acts of foreign countries and (or) a conclusion on the existence of force majeure circumstances.
To successfully operate in the current global environment, Belarusian business entities (hereinafter referred to as entrepreneurs) must consider the impact of restrictive measures on entrepreneurship imposed by the United States, the European Union, and other foreign countries
(hereinafter referred to as economic sanctions).
However, experience shows that entrepreneurs lack understanding regarding the application procedures, legal analysis of economic sanctions, and the consequences of non-compliance. This results in the conclusion of knowingly unenforceable contracts and the accumulation of accounts receivable.
Кроме того, централизованный ресурс, позволяющий ознакомиться с перечнем всех экономических санкций и порядком их применения в рамках конкретного обязательства в настоящее время отсутствует.
Furthermore, there is currently no centralised resource for accessing a list of all economic sanctions and the procedure for their application under a specific obligation. In this regard, the Belarusian Chamber of Commerce and Industry, whose specialists have accumulated significant knowledge and experience in the regulatory framework, legal implementation mechanisms, and risks arising from the imposition of economic sanctions, offers entrepreneurs the opportunity to use its sanctions compliance service.
Sanctions compliance is an opportunity to preliminarily assess the situation and understand effective legal mechanisms for minimising the negative consequences of the introduction of sanctions restrictions.
Sanctions compliance involves:
· a general analysis of the risks of working with residents of sanctioned jurisdictions;
· analysis of foreign economic agreements;
· checking parties to legal relations for the presence of existing personal (individual) restrictions and prohibitions;
· developing recommendations to mitigate the negative consequences of the introduction of restrictive measures.
To obtain sanctions compliance services, an interested legal entity or individual entrepreneur (hereinafter referred to as the applicant) submits an application to the BelCCI, providing the information required for sanctions compliance (e.g., the HS code of the product or other distinguishing characteristics, the country of registration of the foreign counterparty, etc.).
The application must be submitted (sent) to the address: 11, Kommunisticheskaya Str., office 300, Minsk, 220029, Republic of Belarus or by e-mail: mbox@cci.by.
The Belarusian Chamber of Commerce and Industry (BCCI) provides sanctions compliance services under the terms of the agreement concluded with the applicant.
