Round table at Belgospischeprom Concern: from procurement to arbitration courts

The round table ‘BelCCI: acting in the interests of Belgospischeprom enterprises’ was held at the Concern.

The event was opened by Vitaly Vabischevich, Head of the Department of Legal Support and Digital Technologies of the Belarusian Chamber of Commerce and Industry, and Mikhail Chepelin, Deputy Head of the Department - Head of the Foreign Trade Department of Belgospischeprom Concern.

Vitaly Vabischevich spoke about the risks of considering disputes in foreign arbitration (judicial) bodies: what to pay attention to when drafting arbitration clauses in export contracts. He noted that when concluding contracts with large retail chains, the law of the buyer's country is usually applied to the parties to the contract.

The issues of legal mechanisms to protect the supplier from unreasonable claims on product quality, including claims on product breakage and loss of trade dress, were also discussed. The speakers spoke about the possibility of simplifying the algorithm of obtaining a certificate of origin of goods in the form of ST-1 for products that include imported raw materials.

Yulia Borzova, Director of the International Business Department of Belarusbank, drew attention to those organisations that can help in making foreign currency payments. The event also discussed ways to find buyers in the markets of the ‘far arc’ countries.

The participants of the meeting talked about assistance to the enterprises of the confectionery industry in finding companies producing cocoa beans, whose offer should meet the criteria for selecting a supplier under the existing legislation of the Republic of Belarus on procurement (Resolution of the Council of Ministers No. 229 of 15.03.2012, Resolution of the Council of Local Deputies No. 226 of 20.12.2012).
